OFFICIAL CONTEST RULES AND REGULATIONS
Please read these Rules and Regulations carefully, as they contain important information regarding your legal rights, remedies and obligations.
Agenda Sport Marketing Inc. ("Agenda") would like to introduce you to the ING Speed Skating Challenge (the "Contest"), sponsored by ING Insurance Company of Canada ("ING"). Persons using, visiting or accessing the Contest website at www.INGSpeedSkatingChallenge.com (the "Site") shall be hereinafter referred to as "Users". Users agree to abide by the terms of use for this Site (the "Terms of Use") and these official Contest rules and regulations (the "Rules").
- TO ENTER THE CONTEST
The Contest is open to all legal residents of Canada. Persons who are ineligible to participate in the Contest include: (i) employees of Agenda, ING or Comrade Inc.; and (ii) parents, siblings, children and persons domiciled with an employee of Agenda, ING, or Comrade Inc. their agents, parents, affiliated or related companies, and administrators associated with this Contest.
To enter the Contest, participants must visit the Site and follow the instructions therein to submit their entry. Eligible entries must be a sixty (60) to ninety (90) second video that tells the story of why the person became involved with speed skating, identifies his/her community heroes and gives an opinion about the Olympics coming to Canada in 2010. A participant must include his/her first name, last initial, age, phone number, email address, province of residence, Speed Skating Club affiliation and SSC membership number with his/her submission. The Contest will commence at 12:00:01 a.m. Mountain Standard Time ("MST") on October 22, 2008 and the deadline for submissions will be January 18, 2009 at 11:59:59 p.m. MST (the "Contest Period").
No purchase is necessary to enter the Contest.
- THE PRIZES
Each of the top eight (8) submissions, to be determined by ING, Agenda and Catriona Le May Doan, in their sole discretion, will be awarded a Timex Ironman watch and an Hbc Gift Package (retail values of approximately CDN$99 and CDN$125, respectively) and an iPod Nano (retail value of approximately CDN$169).
Each of the top four (4) submissions will be awarded a Samsung Flip Phone (retail value of approximately CDN$380).
Each of the top two (2) submissions (the "Semi-Finalists") will be awarded the Trip (described below), an Ironman Triathlon Digital Heart Rate Monitor, an Hbc Premium Gift Package, an iPod Touch, and a Canon Digital Camera (retail values of approximately CDN$120, CDN$250, CDN$350, and CDN$265, respectively). In addition, the second place submission will win CDN$2500 for his/her speed skating club and the Contest winner will win a CDN$1500 Gift Certificate for one (1) pair of speed skates and CDN$5000 for his/her speed skating club.
Prizes shall also be awarded to the participant who submits the most inspirational video ("Catriona's Most Inspirational Video Winner"), to be determined by Agenda, ING and Catriona Le May Doan, in their sole discretion. Catriona's Most Inspirational Video Winner will not be one of the Semi-Finalists. Catriona's Most Inspirational Video Winner will be awarded the Trip (described below), CDN$1000 for his/her speed skating club, an Ironman Triathlon Digital Heart Rate Monitor, an Hbc Premium Gift Package, an iPod Gift Package, and a Canon Digital Camera (retail values of approximately CDN$120, CDN$250, CDN$350, and CDN$265, respectively).
Agenda reserves the right, in its sole discretion, to determine whether it will award consolation prizes to certain Contest participants who were not selected to be one of the top eight (8) submissions. Such consolation prizes may include the award to such Contest participants of a Timex Ironman watch, or an Hbc Gift Package (retail values of approximately CDN$99 and CDN$125, respectively).
The trip to Calgary, Alberta to attend the ING Oval Finale and Video Awards Party, hosted by ING official spokeswoman, Catriona Le May Doan (the "Trip"), to be awarded to each Semi-Finalist and to Catriona's Most Inspirational Video Winner, shall include round trip economy airfare for three (3) from a major Canadian airport closest to the Semi-Finalists' and Catriona's Most Inspirational Video Winner's places of residence in Canada (hereinafter referred to as the "Departure Point"); two (2) nights accommodation (based on two (2) rooms, double occupancy) at the ING Speed Skating Challenge partner hotel (the "Hotel"); roundtrip airport transfers between the airport and Hotel (all Hotel and air taxes included); and a per diem of one hundred Canadian dollars (CDN$100) per day for three (3) days (March 14-16, 2008). The Semi-Finalists and Catriona's Most Inspirational Video Winner must be accompanied by both a parent or guardian, and a representative or coach of his/her speed skating club who is the age of majority in his/her province of residence (collectively, the "Traveling Companions"). The Semi-Finalists, Catriona's Most Inspirational Video Winner and their respective Traveling Companions are solely responsible for all costs not expressly described herein, including without limitation, applicable taxes, fuel/currency surcharges, transportation during the Trip, medical, accidental and baggage insurance, meals, beverages, room service, gratuities, merchandise, telephone calls, insurance together with any required travel documentation and all personal expenses of any kind or nature. The Semi-Finalists, Catriona's Most Inspirational Video Winner and their respective Traveling Companions are also responsible for all costs incurred to and from the Departure Point as that is where the Trip originates and terminates. The Semi-Finalists, Catriona's Most Inspirational Video Winner and their respective Traveling Companions must be able to travel at the times and dates as determined by Agenda in its sole discretion and authority, failing which the Trip will be forfeited. It is recommended that the Semi-Finalists, Catriona's Most Inspirational Video Winner and their respective Traveling Companion obtain all necessary travel documentation including passports and visas, as applicable, and to satisfy any other customs and immigrations requirements.
In the event a Semi-Finalist and/or Catriona's Most Inspirational Video Winner resides within a 200km radius of Calgary, the Trip will be deemed not to include airfare and such Semi-Finalist and/or Catriona's Most Inspirational Video Winner will instead be given three travel vouchers in the amount of five hundred Canadian dollars (CDN$500) each. In such case, the Semi-Finalist and/or Catriona's Most Inspirational Video Winner, and his/her Traveling Companions will be responsible for arranging their own transportation to and from the Hotel.
The approximate retail value of the Trip (including airfare) is four thousand Canadian dollars (CDN$4000), based on a Toronto departure example. Approximate retail value of the Trip (not including airfare but including the travel vouchers) is four thousand Canadian dollars (CDN$4000).
The Trip must be accepted as awarded with no substitutions. It may not be sold, transferred, is not convertible to cash and it may not be used towards any type of frequent flyer mileage, or other reward point accumulation program. Agenda reserves the right to substitute the Trip in whole or in part in the event that all or any component of the Trip is unavailable. The chances of winning the Trip will depend on the total number of eligible entries received during the Contest Period.
A participant who wins a prize, or multiple prizes, will be sent his/her prize(s) via registered mail once he/she is eliminated from the Contest. Agenda guarantees that all the aforementioned prizes will be in sound condition and in good working order at the time such prizes are awarded. Once these prizes have been awarded: i) Agenda disclaims any and all warranties in relation to such prizes; and ii) the winners of such prizes agree to assume full responsibility for any and all risks relating to such prizes.
- TO WIN
Following the expiry of the Contest Period, Agenda, with the assistance of a panel of voters, including Agenda, ING and Catriona Le May Doan, will select the top eight (8) submissions out of all eligible Contest entries. The top eight (8) submissions will then be posted on the Site. Commencing the week of February 2, 2009, Agenda, acting reasonably, will attempt to contact by telephone the top sixteen (16) submissions and will ask each selected participant to fill out and fax to Agenda a copy of a form of release (see section 4). The top eight (8) submissions will be posted on the Site. In the event any of the top sixteen (16) submissions have not returned their signed release as of February 8, 2009 at 4:00:00 p.m. MST, he/she will forfeit the opportunity to have his/her submission posted on the Site, and another submission willmay be selected by Agenda, in its sole discretion. The top eight (8) submissions shall then be posted on the Site.
Once posted, Users may begin voting for their favourite submissions from 12:00:01 a.m. MST on February 9, 2009 until 11:59:59 p.m. MST on March 20, 2009 by following the instructions on the Site. The online votes will be tabulated at three (3) stages during the Contest. Stage 1 - Online votes made between February 9, 2009 12:00:01 a.m. MST and February 29, 2009 11:59:59 p.m. MST will be tabulated to select the top eight (8) submissions. Stage 2 - Online votes made between February 23, 2009 12:00:01 a.m. MST and March 1, 2009 11:59:59 p.m. MST will be tabulated to select the top four (4) submissions. Stage 3 - Online votes made between March 2, 2009 12:00:01 a.m. MST and March 8, 2009 11:59:59 p.m. MST will be tabulated to select the final two (2) entries. Stage 4 - Online votes made between March 9, 2009 12:00:01 a.m. MST and March 20, 2009 11:59:59 p.m. MST will be tabulated to select the Contest winner. Voting is not cumulative throughout all stages of the Contest. At each stage of the Contest, all submissions that have advanced will begin that stage with zero (0) votes.
Agenda will notify the Semi-Finalists of their Semi-Finalist status by March 3, 2008, at which point the Semi-Finalists are responsible for encouraging members of the public to visit the Site for the purposes of voting for one of the Semi-Finalist submissions. The Contest winner will be announced at the ING Oval Finale and Video Awards Party, hosted by ING official spokeswoman, Catriona Le May Doan, on March 22, 2009.
No voting shall take place in respect of Catriona's Most Inspirational Video Winner, as this winner is determined by Agenda, ING and Catriona Le May Doan in their sole discretion. Agenda will notify Catriona's Most Inspirational Video Winner of his/her status by March 9, 2009.
No correspondence will be undertaken except with the selected participants. The names of these participants may be obtained by viewing the Site, or by sending a self-addressed, stamped envelope after February 9, 2009 to Agenda at 119 9a Street NE, Calgary, AB, T2E 9C5.
- RELEASES
The top eight (8) Contest participants who are selected will be required to release and discharge Agenda, Speed Skating Canada, ING, Catriona Le May Doan and Comrade Inc. from any and all liability of any kind whatsoever arising out of their participation in the Contest, by signing the form, available by clicking here (the "Release"). By signing the Release, the participants acknowledge that they have read and understood these Rules, grant all consents required, authorize Agenda to broadcast, publish and disseminate his/her name, city of residence, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the participants. Further, the participants agree that Agenda, Speed Skating Canada, ING, Catriona Le May Doan and Comrade Inc. will have no responsibility in respect of any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of action which arise out of and /or in any way are related to this Contest, and/or the Trip, in the case of the Semi-Finalists and Catriona's Most Inspirational Video Winner. If the participant is under the age of majority in his/her province of residence, then the release must also be signed by that participant's parent or legal guardian. Failure to sign and return the release via fax or email to Agenda within seventy-two (72) hours of being contacted by Agenda will result in disqualification.
- ACCEPTANCE OF RULES
By entering this Contest participants automatically agree to abide by these Rules and the Terms of Use, available by clicking here. All decisions of Agenda with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all participants in all matters as they relate to this Contest. Agenda reserves the right to vet the content of all submissions and to decide whether content is appropriate and complies with the Terms of Use. Agenda, acting reasonably and in its sole discretion, may disqualify any such submissions.

- PROPRIETARY RIGHTS
Participants acknowledge and agree that all submissions become the sole property of Agenda. Agenda shall own exclusive rights to the submissions, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of all submissions for any purpose, commercial or otherwise, without acknowledgement or compensation to any participant.
- THIRD PARTY CONTENT
Participants agree to abide by the Terms of Use. Generally, participants agree that their submissions will not contain third party content to which the participant does not own the intellectual property rights, or to which the participant has not received permission from the rightful owner. Participants' submissions shall not contain material that infringes on the copyrights, trade-secrets or other proprietary rights of third parties.
- ERRORS
Participants acknowledge that Agenda, and its agencies, including Comrade Inc., will not be held responsible for (i) late, lost, delayed, damaged, misdirected or incomplete submissions; (ii) the failure to receive submissions due to transmission failures or technical failures of any kind; or (iii) any human or computer-generated error in compiling the participants' names or awarding of the prize.
- TERMINATION
Agenda reserves the right, in its sole discretion, to modify, cancel, suspend or terminate the Contest, in whole or in part, without advance notice, for any reason, including without limitation in the event a computer virus or bug, technical failure, unauthorized human intervention or any other cause beyond Agenda's control corrupts or affects the administration, security, fairness or proper conduct of the Contest.
- GOVERNING LAW
The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Any attempts to deliberately damage the Site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made Agenda reserves its right to seek remedies and damages to the fullest extent of the law.
- PRIVACY
By using or accessing the Site, or by entering the Contest, entrants consent to the manner of collection, use and disclosure of their personal information, as described in Speed Skating Nation's Privacy Policy, available by clicking here. Any inquiry concerning the personal information held by Agenda should be emailed to the Agenda Privacy Officer at privacy@speedskatingnation.com.
- QUEBEC RESIDENTS
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
